APA Ethics Director Consulted on Development of BSCT Training Program

A new report by what New York Times reporter James Risen called "a group of dissident health professionals and human rights activists" has provided the best proof yet of collaboration and links between the CIA, Department of Defense, and the American Psychological Association (APA) regarding the government's interrogation program.

Not noted in the report but revealed here for the first time is the fact that APA's long-time Ethics Director Steven Behnke worked directly with Department of Defense officials in creating a training curriculum for psychologists working with interrogators at Guantanamo and elsewhere. He has never revealed his role in that.

It has been widely reported, and was the topic of two major Congressional investigations, that both CIA's and DoD's interrogation programs involved widespread use of torture. This policy was supported and endorsed at all levels of the Executive Branch, and the programs involved were repeatedly funded by Congress. Indeed, a high-level report to the Joint Chiefs of Staff that I obtained recently via FOIA indicated that detainee facilities at Guantanamo's Camp Delta were built early on via solicitation of emergency contingency funds from the House and Senate intelligence committees.

The new report, All the President's Psychologists: The American Psychological Association’s Secret Complicity with the White House and US Intelligence Community in Support of the CIA’s ”Enhanced” Interrogation Program (PDF), draws on a cache of over 600 emails from a former RAND employee and presumed CIA contractor, Scott Gerwehr, who died in a mysterious accident in 2008.

The narrative -- as constructed by report authors, psychologists Stephen Soldz and Steven Reisner, and Nathaniel Raymond, Director of Harvard's Signal Program on Human Security and Technology -- concentrates on events surrounding three key events: a July 2003 joint APA/CIA/RAND conference on "The Science of Deception"; a July 20, 2004 "confidential meeting between senior APA staff and senior national security psychologists and behavioral research personnel"; and the circumstances surrounding the June 2005 APA Task Force meetings, over a single weekend, to rush out policies on Professional Ethics and National Security, producing a report on the same (PENS).

While there is much that can be discovered from a close reading of the report and its accompanying documentation (one only wishes that more of the emails were released), one of the leading figures throughout the entire APA drama is its Ethics Director, Stephen Behnke.

Behnke Accused

As pointed out in a "Fact Sheet" on Behnke, put out by the Soldz and Reisner-linked Coalition for an Ethical Psychology in February 2011, the APA Ethics Director had been a key player in "the creation and management" of the PENS task force. Behnke kept the membership of the task force secret, even as it later turned out the members were largely drawn from the military and intelligence fields.

Indeed, an important email released in the new Soldz/Reisner/Raymond report describes the Science Policy Director at APA, Geoff Mumford, telling Kirk Hubbard, the chief of the CIA's Research & Analysis unit at the Operational Assessment Division, Special Activities Division, CIA, that the PENS task force members were "very carefully selected" to represent his views and that of CIA psychiatrist Charles "Andy" Morgan and DoD intelligence official Kirk Kennedy.

The Coalition fact sheet also criticized Behnke with ignoring blatant conflicts of interest among PENS personnel. They specifically cited the selection of Russ Newman, then Director of APA's Practice Directorate" to be an observer at the PENS meetings. The Coalition continued, "Dr. Newman's wife was Lt. Col. Debra Dunivin, a member of the Guantanamo Behavioral Science Consultation Team (BSCT) -- the very form of psychologist involvement that was a primary focus of the PENS Task Force's ethics deliberations."

The BSCTs were formed in the very early days of holding "war on terror" prisoners at Guantanamo. Over time, they were exposed as assisting interrogators in ferreting out psychological weaknesses, and even proposing "exploitation" of those weaknesses to interrogators.

But it wasn't Behnke who sent Newman to PENS. Newman was recommended by then-APA Board of Director liaison, Dr. Barry Anton. Anton is the current President of APA.

As for Dunivin, a 2004 APA Monitor story identifies her as also being a SERE psychologist. SERE is the U.S. military's program to inoculate soldiers and intelligence officers to the hardships of capture by foreign forces or terrorists. It includes a mock-torture camp experience, the procedures of which were utilized in forming the CIA's "enhanced interrogation" torture program, reportedly devised by former SERE psychologists James Mitchell and Bruce Jessen.

Consulting with DoD on the BSCTs

The Coalition noted that after the PENS report was released and approved by the APA, Dunivin "subsequently joined members of the Task Force in revising the BSCT instructions on the basis of the PENS report." While the Coalition simplifies history a small bit here -- they were not simply "revising" BSCT instructions but developing a training curriculum for BSCT members, at the direction of then-Surgeon General Kevin Kiley.

Still, it is true that Dunivin and other PENS members, including Larry James, another Guantanamo BSCT, and Special Forces psychologist Morgan Banks, became advisers to top military officials on the organization of the BSCTs. They all attended a meeting on August 5, 2005, only a month after the public release of the PENS report, with its finding that it was ethically appropriate to work with government interrogators working with detainees in the "war on terror," a stance which was rejected by both the American Medical Association and the American Psychiatric Association.

It is with some irony that Behnke's own role working on the new BSCT training was revealed in a 2014 book chapter written by Dunivin and another Special Operations psychologist, Jay Earles.

In an essay entitled "Behavioral Science Consultation to Interrogation and Detention Operations: Policy, Ethics, and Training" (PDF) (Ch. 14 in the book Forensic and Ethical Issues in Military Behavioral Health, Borden Institute, 2014), Dunivin and Earles describe the tasking from Medical Command and the Surgeon General's office in 2005 to create new BSCT guidelines and procedures.
Then surgeon general of the Army, Lieutenant General Kevin Kiley, convened a group in the summer of 2005 to develop doctrine in this specialized area. He assembled subject matter experts, including several psychologists and psychiatrists who had served as BSCs, a medical ethicist, a military attorney, a master interrogator, and two general officers who trained and educated military medical personnel.
Dunivin and Earles don't go into more details on the tasking, but on May 24, 2005, Kiley approved the findings of a report by a "Functional Assessment Team" he had sent to Guantanamo and both Iraq and Afghanistan theater of operations to assess medical operations. (It is worth noting that by January 2004, BSCT staffing was only by psychologists.)

The recommendations in the report (long PDF) included this: "DoD should develop well defined doctrine and policy for the use of BSCT personnel. A training program for BSCT personnel should be implemented to address the specific duties." Some of the development of BSCT operating procedures and organizational definitions and boundaries can be ascertained by comparing an early 2002 version of BSCT Standard Operating Procedures with a DoD 2008 policy statement on BSCTs, which includes a section describing the training program devised back in 2005.

As Dunivin and Earles describe it, military authorities at MEDCOM and the Surgeon General's office were closely following the debates at medical and psychological associations regarding medical professionals in so-called behavioral consultant roles in interrogation. The military drew on a number of "experts" of their own, including Army, Navy and Air Force psychologists, and other personnel from JSOC, the Counterintelligence Field Activity office, the Air Force's Office of Special Investigations, Joint Personnel Recovery Agency (then parent-command for SERE), the Army's Intelligence and Security Command, and the Criminal Investigation Task Force.

Consultants also came from the shadowy Intelligence Science Board, which is best known for its 2006 report, Educing Information -- Interrogation: Science and Art (large PDF). The members of the board are drawn from the intelligence community, broadly defined. It includes two members of the PENS board, NCIS's Mike Gelles and CIA's Scott Shumate, as well as the former Chief of the “Interrogation Control Element” in Guantanamo, David Becker.

Dunivin and Earles singled out Behnke as a significant consultant, though not by name, only title:
From the earliest stages, professional ethics and law were significant components of the curriculum development process; APA’s ethics director and staff judge advocates (attorneys) with expertise in law relative to interrogations and detention operations were consulted to ensure concordance with the ethics and the law." [bold emphasis added]
The APA ethics director then, and still is, Stephen Behnke. I emailed Dr. Behnke and asked for his input, including information on dates he consulted or "any information you deem helpful in understanding or describing your work in this regard." As of publication, Dr. Behnke had not responded to my request. It seems likely his contribution occurred roughly around the same period as that of Dunivin and Banks, i.e., early August 2005, maybe even that same meeting Morgan Banks mentioned on August 5.

In general, we can only say Behnke's contribution to DoD most likely came in the summer of 2005, and certainly well before the October 2006 release by MEDCOM of policy guidelines for medical personnel assigned to BSCTs (OTSG/MEDCOM Policy Memo 06-029). The PENS report was "Enclosure 1" to the 2006 MEDCOM guidelines.

There was also an intriguing October 2005 visit by various "delegates from several major health and mental health associations, medical ethicists," and others to Guantanamo to "learn more about operations and speak with DoD officials and other delegates about appropriate and effective roles of healthcare professionals in detainee operations."

The BSCTs and "Learned Helplessness"

To understand the egregious nature of Behnke's contribution, it is important to remember that he never indicated that he had any role in the current construction of the BSCTs, while he continued to be involved in ethics matters related to complaints against former BSCT members, and while he continued to talk and make recommendations regarding APA ethics policy in relation to torture and the BSCTs.

But matters stand even worse when you consider that participation with a BSCT program meant you accepted the authority of the interrogating regime. This meant Behnke had to overlook the human rights violations inherent in the detention of the detainees, especially at Guantanamo, with its emphasis on total control over prisoners, use of isolation, sleep deprivation, and other manipulations of environment, forced injections of drugs, and brutal guard attacks. The insistence that most prisoners' detentions are in effect indefinite in nature, and that even those the government believes to be innocent or without intelligence value can be held in theory forever, is a gross violation of human rights norms, as well as deleterious to the health of the prisoners involved. Also alarming is the fact the training of BSCTs that was developed, and described in MEDCOM's 2006 policy guidelines, included as a specific recommendation the possession of "professional level expertise" in the "application" of "learned helplessness" as an area of "behavioral science" relevant "to the interrogation/debriefing process."

Learned helplessness (LH) was originally a theory developed by psychologist Martin Seligman. Seligman was a known consultant to SERE, and had met two or three times with James Mitchell, including at least once at Seligman's house. The emails revealed by Soldz and his co-authors show that Seligman had also worked for or consulted to the CIA, presumably at Kirk Hubbard's CIA Operational Assessment Division.

LH was subsequently the theoretical model behind the development of the CIA's "enhanced interrogation" torture program, with the idea that use of inescapable shock and fear would break down captives into a state of "learned helplessness" -- "learned" in the psychological sense of being conditioned. Indeed, the BSCT curriculum also calls for expertise in use of operant and classical conditioning.

Whether Behnke knew of the inclusion of the "learned helplessness" recommendation is impossible to say with complete certainty. But he should have known. Or he should have known after the fact.

It is now more understandable why APA has refused to call for the closure of Guantanamo, or why they have stalled in implementing an APA-member-derived referendum on pulling psychologists out of human rights violating settings like Guantanamo -- one of their chief officers was involved in setting up the regime there, at least as it concerns the use of behavioral consultants.

Torture Program Assists Spread of Endemic Corruption

The meaning of the APA scandal opened up by the Soldz/Reisner/Raymond report, and James Risen's reporting on same in the New York Times, must be seen in the context of a much larger breakdown in ethical standards by the wider society at large, particularly, though not exclusively, when it comes to the torture scandal.

Most recently, we've seen that key figures from the Bush administration torture program have gone on to hold important positions in the Obama administration. A recent New York Times article by Mark Mazzetti and Matt Apuzzo last month showed how CIA officials implicated in the torture program, like former CIA Counterterrorism Center official Michael D’Andrea, who Obama put in charge of the CIA's drone operations. Meanwhile, former CIA officials from the days of the Bush administration torture program still essentially run the Agency -- John Brennan as Director, and Greg Vogel as chief of the Directorate of Operations.

President Obama's insistence that the nation should move on from the torture scandal, and his refusal to further investigations or prosecutions, is totally self-serving when looked at in the light of recent revelations.

It is worth noting that APA did not operate in a void either. They drew upon a top echelon of behavioral scientists when they worked with CIA or SERE officials, including, as I've noted in the past Albert Bandura, Richard Lazaraus, and Charles Speilberger, and more recently we have revelations regarding Seligman and Paul Ekman. As when CIA drew on the cream of behavioral science during the days of MKULTRA, many of these scientists and researchers are unwitting, in that they do not know (or deceive themselves) they are contributing to a torture program. But some of them certainly are very close to the CIA or other government intelligence agencies.

The APA announced last year they would conduct an "independent" investigation, and hired Chicago attorney (and former mayoral candidate), David Hoffman. Hoffman's report is supposed to be out in in another month or so. But the entire investigation is riddled with conflicts of interest. Hoffman used to work on the staff of the Senate Select Committee on Intelligence with soon-to-be CIA director George Tenet, the very man who led the CIA during the creation of the torture program.

The corruption of the APA is not very different than the corruption of many U.S. societal institutions, especially the police and the prison system, whose full racist and oppressive character is in the news daily lately. But this corruption is not reason for despair, but for further struggle. The actual roles of "experts" like Stephen Behnke need to be exposed, and the real nature of the institutions they serve revealed.

DoD Report Reveals Some Detainees Interrogated While Drugged, Others "Chemically Restrained"

Detainees in custody of the US military were interrogated while drugged with powerful antipsychotic and other medications that "could impair an individual's ability to provide accurate information," according to a declassified Department of Defense (DoD) inspector general's report that probed the alleged use of "mind altering drugs" during interrogations.

In addition, detainees were subjected to "chemical restraints," hydrated with intravenous (IV) fluids while they were being interrogated and, in what appears to be a form of psychological manipulation, the inspector general's probe confirmed at least one detainee - convicted "dirty bomb" plotter Jose Padilla - was the subject of a "deliberate ruse" in which his interrogator led him to believe he was given an injection of "truth serum."

Truthout obtained a copy of the report - "Investigation of Allegations of the Use of Mind-Altering Drugs to Facilitate Interrogations of Detainees" - prepared by the DoD's deputy inspector general for intelligence in September 2009, under a Freedom of Information Act (FOIA) request we filed nearly two years ago.

Over the past decade, dozens of current and former detainees and their civilian and military attorneys have alleged in news reports and in court documents that prisoners held by the US government in Guantanamo, Iraq and Afghanistan were forcibly injected with unknown medications and pills during or immediately prior to marathon interrogation sessions in an attempt to compel them to confess to terrorist-related crimes of which they were accused.

The inspector general's investigation was unable to substantiate any of the allegations by current and former detainees that, as a matter of government policy, they were given mind-altering drugs "to facilitate interrogation."

But the watchdog's report provides startling new details about the treatment of detainees by US military personnel. For example, the report concludes, "certain detainees, diagnosed as having serious mental health conditions being treated with psychoactive medications on a continuing basis, were interrogated."

Leonard Rubenstein, a medical ethicist at Johns Hopkins Center for Public Health and Human Rights and the former president of Physicians for Human Rights, said, "this practice adds another layer of cruelty to the operations at Guantanamo."

"The inspector general's report confirms that detainees whose mental deterioration and suffering was so great as to lead to psychosis and attempts at self-harm were given anti-psychotic medication and subjected to further interrogation," said Rubenstein, who reviewed a copy of the report for Truthout. "The problem is not simply what the report implies, that good information is unlikely to be obtained when someone shows psychotic symptoms, but the continued use of highly abusive interrogation methods against men who are suffering from grave mental deterioration that may have been caused by those very same methods."

Shayana Kadidal, the senior managing atty of the Guantanamo Project at the Center for Constitutional Rights, said the report, which he also reviewed, "reinforces that the interrogation system at Guantanamo was a brutal system."

"One of the things that struck me after reading this," Kadidal said, "is under the system set up by the [US Court of Appeals for the District of Columbia], any statements detainees made during these interrogations would be presumed accurate even if detainees took medication that could produce unreliable information."

"The burden ends up falling upon the detainee to prove what was said wasn't accurate if they were challenging their detention" in habeas corpus proceedings, Kadidal added.

Explaining the rationale behind forcibly drugging detainees, the former commander of the Joint Medical Group at Guantanamo said, "some detainees were involuntarily medicated to help control serious mental illnesses," according to the report, which added that an ethics committee approved of such plans.

"For example, one detainee had a piece of shrapnel in his brain which resulted in control problems and a limited ability to provide effective consent," the report said.

The detainee with the shrapnel injury may be Abu Zubaydah. In 1992, Zubaydah had suffered a shrapnel wound to the head while fighting on the front lines of a civil war in Afghanistan. Brent Mickum, Zubaydah's habeas attorney, said the high-value detainee has been routinely overdosed with Haldol, the only drug the inspector general identified that was used on certain detainees.

But the report suggests detainees were often not told what types of drugs they were given when they asked or for what purpose it was administered.

Brandon Neely, a former Guantanamo guard who was at the prison facility the day it opened in January 2002, told Truthout, "medics never informed the detainees what the medication was."

"The medics walked around with little white cups that had pills in it a couple of times a day," said Neely, who sometimes accompanied the medics when they distributed the medication. He added that if detainees refused to take it an "Immediate Reaction Force" team, who guards would call to deal with resistant or combative detainees, would administer the medication to prisoners by force.

Rubenstein said the failure to inform prisoners what drugs they were given means "some basic principles of medical ethics were cast aside, especially those requiring a doctor to explain his or her recommendation and seek consent for it as an affirmation of the dignity and autonomy of the patient."
"Even where consent is not forthcoming and involuntary medication is allowed after voluntary medication is not accepted, it should never take place unless this process is followed," Rubenstein said.

The cumulative effects of indefinite detention, interrogations, use of drugs, and other conditions of confinement also appear to have taken a toll on the detainees' mental state and impacted the DoD watchdog's ability to conduct a thorough investigation.

Indeed, when the inspector general sought to interview the attorney representing one detainee who claimed he was given mind-altering drugs during interrogations, the attorney responded, "at this state of his incarceration, [redacted] memory is severely compromised and, unfortunately, we are skeptical that he can provide you with any further details ..."

The investigation also found instances where "chemical restraints" were used on detainees "that posed a threat to themselves or others," which Rubenstein said, "is contrary to US Bureau of Prison regulations, decisions of the US Supreme Court and to medical ethics principles that forbid subordinating the patient's medical interests to prison security."

Lt. Col. Todd Breasseale, a Defense Department spokesman, said, "as a matter of long-standing department policy," he could not comment on whether "chemical restraints" continue to be part of the Standard Operating Procedure (SOP), also known as Tactics, Techniques, Procedures (TTPs), at Guantanamo and other prisons operated by the DoD because "doing so might not only compromise security but [the SOPs] are 'living' documents, subject to regular change and updating."

Media Report Sparked Probe

The inspector general's yearlong probe was launched in June 2008, two months after the publication of a Washington Post report in which some detainees claimed they were forcibly drugged and coerced into making confessions.

One of the detainees at the center of The Washington Post report, Adel al-Nusairi, a former Saudi policeman who was imprisoned at Guantanamo from 2002 to 2005, is prominently featured in the inspector general's report and identified as "IG-02."

According to his attorney's notes cited in The Washington Post, al-Nusairi claimed he was injected with an unknown medication that made him extremely sleepy just before he was interrogated in 2002. When his captors awakened him, he fabricated a confession for US interrogators in hopes they would leave him alone so he could sleep.

"I was completely gone," al-Nusairi told his attorney, Anant Raut. "I said, 'Let me go. I want to go to sleep. If it takes saying I'm a member of al-Qaeda, I will.'"

The inspector general's review of al-Nusairi's medical records showed he was diagnosed as "schizophrenic and psychotic with borderline personality disorder" and injected with Haldol, a powerful antipsychotic medication, whose side effects include lethargy, tremors, anxiety, mood changes and "an inability to remain motionless," according to the watchdog's report.

Haldol can also cause the usually irreversible movement disorder known as tardive dyskinesia. But the inspector general did not say that in his report. The inspector general noted al-Nusairi had told his interrogators he was being forced to take monthly injections that he no longer wanted to receive. The report said "uncooperative" detainees were sometimes forcibly injected with psychoactive medications.

But the investigation concluded there was "no evidence that [al-Nusairi] was administered shots during interrogation."

Despite his diagnosis and the unreliability of the information he provided to his interrogators due to the effects of the antipsychotic medication, al-Nusairi was declared an enemy combatant after he confessed to being a member of al-Qaeda and imprisoned at Guantanamo for three more years before finally being repatriated to Saudi Arabia.

"I think any rational person would agree that confessions of terrorism while under the influence of mind-altering drugs are about credible as professions of love while under the influence of alcohol," Raut, al-Nusairi's attorney, told Truthout.

Two days after The Washington Post story was published, then-Sen. Joe Biden, who at the time was chairman of the Senate Foreign Relations Committee; Sen. Carl Levin, chairman of the Senate Armed Services Committee; and Sen. Chuck Hagel, a senior member of the Foreign Relations Committee and the Senate Select Committee on Intelligence, sent a letter to DoD Inspector General Claude Kicklighter urging him to investigate the detainees' allegations and to focus solely on whether the Department of Defense and its sub-agencies issued written and/or oral policy authorizing the use of "mind-altering drugs to facilitate interrogations."

The CIA's inspector general also conducted an investigation at the request of the Democratic lawmakers into the claims about the use of mind-altering drugs pertaining to detainees in custody of the agency. That report, which Truthout is also seeking under the FOIA, remains classified.

Investigative Gaps

The inspector general reviewed Department of Defense interrogation policy from 2001 through 2008 and interviewed more than 70 military intelligence and medical officials who had oversight of detainee operations in Iraq, Afghanistan and Guantanamo. Top military intelligence officials interviewed by the inspector general said they were "unaware" of any special access "black" program, policies, direction or order authorizing the use of drugs as an interrogation tactic or to "facilitate interrogations."

The watchdog also looked at classified and open-source documents, including detainees' medical records and 1,620 interrogation plans covering 411 detainees between August 2002 and January 2005.

"No interrogation plans were noted which mentioned drugging, medicating, or threatening to drug or medicate a detainee to facilitate interrogation," according to the report, which added that a separate review of detainees' medical records documenting their "physical and psychological care and treatment" did not turn up any evidence "of mind-altering drugs being administered for the purposes of interrogation."

"The 'headline' here is that there's no evidence of any organized, systematic [Department of Defense] effort to use drugs for interrogation purposes," said Gregg Bloche, the author of "The Hippocratic Myth" and a health policy expert and professor of law at Georgetown University who also reviewed the inspector general's report for Truthout. "Can isolated cases of drug use for interrogation purposes be absolutely ruled out? No - as the report acknowledges, there are gaps in evidence available to the [inspector general]. But if there were such cases, they were likely few and far between."

But it appears that the probe did not scrutinize other documents, such as a second set of detainee medical records maintained by the Behavioral Science Consultant Teams or BSCTs that may have contained information relevant to the inspector general's investigation into the use of mind-altering drugs during interrogations.

The BSCTs were made up of psychologists and other mental health technicians and, at one time, psychiatrists. The BSCTs work closely with interrogators in crafting interrogation plans based on the psychological assessments of a detainee's weaknesses. The BSCT psychiatrists and at least one psychologist who passed a special Defense Department psychopharmacology program were able to administer drugs, at least in principle.

Human rights activists have long believed the Defense Department controlled a second set of detainee medical records, but evidence never surfaced to support the suspicions.

However, Truthout has uncovered previously unreported testimony from Army Surgeon General Kevin Kiley's 2005 report on detainee medical operations in Guantanamo, Iraq and Afghanistan (pg. 18-13) that confirms the suggestion.

Kiley indicated that, while BSCTs were not medical personnel and "did not document the medical condition of detainees in the medical record," they "did keep a restricted database which provided medical information on detainees."

Rubenstein added, "if drugs were used those BSCT records should be consulted."

Jose Padilla and "A Deliberate Ruse"

The report also delves into the area of so-called "truth" drugs, which are administered for their presumed mind-altering effects.

Since the start of the "war on terror," intelligence officials have publicly said drugs like sodium pentothal should be introduced in interrogations as a way of getting "uncooperative" detainees to talk.

"We ought to look at what options are out there," former FBI and CIA Director William Webster told reporters in 2002.

The inspector general's report pointed to instances in which top military officials had considered introducing "truth" drugs during interrogations. The watchdog cited an October 2, 2002 meeting of Guantanamo interrogation command and legal staff where the use of "truth serum" on detainees was discussed as having a "placebo effect."

George Bimmerle discussed the use of placebos as ersatz "truth drugs" in a classic 1961 CIA text titled "'Truth' Drugs in Interrogation." Bimmerle wrote that placebos are "most likely to be effective in situations of stress." The drugs are described as acting upon "a subject's sense of guilt," absolving a prisoner under interrogation of responsibility for giving up information, because it is assumed the effect of the drug was to blame.

Interrogators utilized the "placebo effect" when they questioned convicted terrorist Jose Padilla, a US citizen who was arrested in May 2002 on suspicion of plotting to build and detonate a dirty bomb and held as an enemy combatant at the US Naval Brig in South Carolina.

Padilla's federal public defender, Michael Caruso, in a 2006 federal court filing, claimed Padilla was "given drugs against his will, believed to be some form of lysergic acid diethylamide (LSD) or phencyclidine (PCP), to act as a sort of truth serum during his interrogations."

Sanford Seymour, the technical director of the US Naval brig in South Carolina where Padilla was held, however, vehemently denied the charge during a 2006 hearing to determine whether Padilla, a US citizen, was competent to stand trial. Seymour asserted Padilla was injected with an influenza vaccine.

But what Seymour failed to disclose, reported here for the first time, was that Padilla was given the flu shot during an interrogation session and told by his interrogators the injection was "truth serum."

The inspector general's probe determined "the incorporation of a routine flu shot into an interrogation session ... was a deliberate ruse by the interrogation team, intended to convince [redacted, Padilla] he had been administered a mind-altering drug," such as LSD.

Investigators from the inspector general's office reached that conclusion after a visit to the Naval Brig where they reviewed records and interviewed Brig officials about Padilla's claims.

Padilla's name is redacted from the report, but it's clear, based on the detailed descriptions of the allegations, the inspector general is referring to him. The report says the FBI and Joint Task Force 170, the "predecessor organization" of Joint Task Force Guantanamo, interrogated Padilla from June 2002 through October 2002. The Defense Intelligence Agency (DIA) took over his interrogations from October 2002 through March 2003 at which point the FBI and DIA jointly conducted the interrogations.

The inspector general's office also viewed some of Padilla's interrogation videotapes where Padilla "expressed concern about the possible use of drugs to induce him to cooperate with the interrogators."

"The most detailed discussion of truth serum occurred on November 14, 2002, after [redacted] declined to take a polygraph examination," according to the inspector general's report. "The interrogation video recording depicts that following the polygraph declination, [redacted] and the interrogator had a discussion of other techniques which could be used to verify [redacted] statements. Among the techniques described by the interrogator was the use of a 'truth serum.'"

At the end of the tape, according to the inspector general, the interrogator told Padilla, "There is no such thing as a 'truth serum.'" But the initial suggestion apparently affected the detainee when he was given a flu shot during his interrogation session about three weeks later. Padilla asked his interrogator why he was given a shot.

"It was necessary," the interrogator said, "and proceeded to ask [redacted] what kind of shot he received."

Padilla said he was told it was a flu shot, but as the interrogation wore on he said he did not feel well and asked, "what did you shoot me with? Did you shoot me with serum?"
Bloche, the health policy expert and Georgetown University law professor, said the ruse interrogators pulled on Padilla "sounds like a juvenile prank."

"But it's a serious breach of medical ethics," Bloche said. "It undermines trust in military physicians and it's an unfair insult to the integrity of the vast majority of military doctors, who quite rightly believe that this sort of thing is contrary to their professional obligation."

The inspector general rebuked a government agency - possibly the DIA or FBI - involved in Padilla's interrogation for failing "to follow legal review procedures" established by US Joint Forces Command.

Padilla was convicted of terrorism support charges in 2007. Recently, the Supreme Court refused to hear an appeal Padilla filed against former Secretary of Defense Donald Rumsfeld and other Bush administration officials. The high court let stand an appeals court ruling, which dismissed Padilla's complaint related to his treatment at the Naval Brig. Caruso, Padilla's federal public defender, did not return messages left at his Miami office for comment about the inspector general's conclusions.

But just a few months after the deception on Padilla, according to the inspector general's probe, an unnamed DIA "representative" came up with a list of 40 techniques at the request of a Pentagon "working group" overseen by former Secretary of Defense Donald Rumsfeld that met between January and April 2003 to discuss interrogation methods to use on detainees captured in the global war on terror.

The "DIA representative" was identified in a declassified 2009 Senate Armed Services Committee report that probed the treatment of detainees in custody of the US military as Dave Becker, the Interrogation Control Element (ICE) Chief at Guantanamo. Becker recommended to the "working group" the use of drugs, "such as sodium pentothal and Demerol," which was number 40 on the list of interrogation methods presented to the "working group." Becker said those drugs "could prove to be effective" and "relaxes detainee to a cooperative state."

When Senate Armed Services Committee investigators interviewed him about the list of interrogation techniques, Becker said he had recommended the "use of drugs" to Rumsfeld's panel because he'd heard "a rumor" that another agency "had used drugs in their interrogation program."

The inspector general's report went on to say the working group ultimately rejected the use of drugs. But the report failed to mention an important document: a March 2003 legal opinion sent to Pentgaon general counsel William "Jim" Haynes by Justice Department Office of Legal Counsel attorney John Yoo, which said drugs could be used in interrogations as long as they did not "disrupt profoundly the senses or personality." Yoo's memo was cited in the senators' letter to the inspector general calling for the investigation. It's unclear why it was not mentioned in the watchdog's report.

The investigation also reviewed published reports prepared by the US government and human rights organizations revolving around the treatment of detainees in US custody. One report scrutinized was Kiley's 2005 US Army surgeon general report on detainee medical operations in Guantanamo, Iraq and Afghanistan, which said a doctor refused "to provide cough syrup as a 'truth drug'" to an Iraqi detainee. The inspector general interviewed this doctor, who indicated the request, which he turned down as unethical, came from his "brigade S-2 (Intelligence Officer)."

The surgeon general's report also said a licensed practical nurse saw "sedatives (ativan, diazepam, etc.) being used by medical personnel to calm a [Iraqi] detainee so that the detainee would talk more."

According to the DoD inspector general's investigation, after the watchdog attempted to obtain a sworn statement from the nurse, identified in its report as a "non-commissioned officer," about the use of sedatives on detainees, the nurse "elected to make a corrective statement" to what he had claimed three years earlier.

"Sedatives were only given to patient detainees to alleviate pain," the nurse's statement now says.

"They Said It Was Some Candy"

The inspector general's office also received permission from the deputy secretary of defense to interview three detainees in January 2009 about their claims of being forcibly drugged during interrogations. An attorney for one of the detainees declined the interview request. The inspector general did not attempt to interview detainees who claimed they were administered mind-altering drugs during interrogations and have since been repatriated.

The names of the two detainees interviewed are redacted in the report.

The detainee told the inspector general after he was captured in Karachi, Pakistan, by Pakistanis in September 2002 where he held for three days he was transferred to the "Prison of Darkness," in Kabul, Afghanistan for 40 days. He was then sent to the US prison base at Bagram for about a week and then shipped off to Guantanamo.

"[Redacted] stated that during an interrogation at Bagram he was given pills; green and red ones," according to statements the detainee gave the inspector general in April 2009. "After I ate like three of them, my tongue started getting heavier. After that, I woke up and they (interrogators) said thank you very much, we've got what we need. After I ate the stuff, it was like a state of delusion ... it took like three-four days to (feel normal again). I was not normal until I came to Cuba and then I started to feel my mind back. It was a state of delusion. Like everything was a dream. My sensation was not great."

The inspector general asked the detainee if he was told what the pills were.

"At the time they said it was some candy. And I was so hungry so I ate it," the detainee said.

The inspector general then asked the detainee if it was possible what he had experienced at the "Prison of Darkness" was due to exhaustion.

"I don't remember exactly," the detainee said. "If you saw my condition in the Prison of Darkness after 40 days of being tortured and having to stand all the time at Bagram. Those were things consuming my mind at the time ... when I start to remember that, I get somewhat upset, because it was a terrible event in my life. When you had been standing for three-four days in a row, I was so tired, I was exhausted. I can't describe those sensations."

Interrogators who questioned the detainee were interviewed by the inspector general's office. They did not remember the detainee "as each had interrogated over 100 persons during their respected assignments." They denied giving detainees drugs or medication for "interrogation purposes" and never witnessed other military personnel administer detainees drugs. The interrogators said, however, they "frequently gave the detainees food and candy to reward or encourage them to talk," such as "Fruit Loops," "Jolly Ranchers," "cookies," "suckers," and "Taffy's."

"Based on the statements provided by the interrogators and lacking any evidence of drugging, we concluded that we could not substantiate [redacted] allegation," the inspector general's probe concluded.

The inspector general also interviewed a detainee who was captured in Faisalabad, Pakistan, in March 2002 and claimed after he was transferred to Guantanamo that summer an interrogator told him "he would give me something that will make me talk."

However, the watchdog was unable "to correlate this information with records and documents pertaining to [the detainee's] interrogations."

Responding to the completion of the investigation in August 2009, J. Alan Liotta, the principal director in the office of detainee policy, warned in a letter to the inspector general signing off on the document, "The release of this report is likely to generate media attention."

"Please keep our office informed as to when it will be released and efforts to craft talking points regarding the release," Liotta wrote, signing off on the report.

Center of the Storm: Fight to Expose the Torture Planners

Previously I described the new Vanity Fair article by Katherine Eban, which details how CIA and SERE psychologists directly implemented and spread torture at U.S. government bases and prisons abroad. (See Vanity Fair Article Links CIA/SERE Psychologists to Torture.) I noted that

From afar, this all looks like a crazy trip through a double looking glass. The insanity of even discussing the "right" way to conduct illegal interrogations in the "war on terror" belies a moral and political bankruptcy so profound that it may take us an entire political and social epoch to extirpate it.

Now, in the wake of the VF revelations, Psychologists for an Ethical APA (PEAPA) have released a press statement calling for a fundamental overhaul of the premier psychological organization in the United States, and an investigation of its leading members, as the tentacles of the U.S. torture apparatus have reached deep down into American civil and academic society.

The Politics of Torture

From the PEAPA statement, dated July 17, 2007 (Emphases are added in bold and not in original):

Today’s deeply disturbing revelations in Vanity Fair show the essential role US psychologists played in the torture of detainees in CIA and Department of Defense (DoD) custody, heightening the urgent need for the American Psychological Association (APA) to issue clear ethical guidelines prohibiting psychologists in the military or intelligence services from violating basic human rights as part of interrogation processes, the Coalition for an Ethical APA stated.... When read in conjunction with the recently declassified Defense Department investigation which revealed that psychologists re-engineered counter-terrorist training techniques as mechanisms for detainee abuse at Guantánamo, in Afghanistan and in Iraq, this article is an indictment not only of participating psychologists, but of the Association which refuses to condemn these practices.

As will be clear, much of the press release concerns the politics around a fight within the APA to stop psychologist participation in coercive interrogations. That psychologists and other health care workers have participated in such is irrefutable, as evidenced by the VF article, and in such documentary works by others, including myself.

The politics of the fight within APA now centers around a proposal by dissident psychologists to pass a moratorium resolution this August, coincident in time with the 2007 APA Convention in San Francisco, calling for APA to ban psychologist participation in national security interrogations in the "war on terror" as historically and inherently abusive. The APA leadership, for their part, maintain that psychologist presence at such interrogations actually facilitates their supposedly non-abusive character.

The APA has posted the response of their division for Military Psychology (Division 19, the Society for Military Psychology) to the proposed moratorium:

... military psychologists believe they are performing a valuable service by being included in the interrogation process....

The ethical and clinical training of psychologists make them more likely to be protective of the detainees' interests than those who have not had such training. Psychologists are more likely to recognize when interrogations are headed in a direction that would be psychologically harmful to the detainees and are thus more likely to deter interrogations from heading in that direction.

Hmmm... Well, let's keep that in mind when we consider this quote from Eban's VF article. (For those who don't know, the SERE acronym refers to the Pentagon's Survival, Evasion, Resistance, Escape program, which is supposed to "stress inoculate" U.S. soldiers against the POW experience. JTF-GTMO refers to Joint Task Force Guantanamo. BSCT refers to Behavioral Science Consultation Team.)

On December 2, 2002, Secretary of Defense Donald Rumsfeld granted JTF-GTMO 170's request to apply coercive tactics in interrogations. The only techniques he rejected were waterboarding and death threats. Within a week, the task force had drafted a five-page, typo-ridden document entitled "JTF GTMO 'SERE' Interrogation Standard Operating Procedure."

The document, which has never before been made public, states, "The premise behind this is that the interrogation tactics used at US military SERE schools are appropriate for use in real-world interrogations" and "can be used to break real detainees."

The document is divided into four categories: "Degradation," "Physical Debilitation," "Isolation and Monopoliztion [sic] of Perception," and "Demonstrated Omnipotence." The tactics include "slaps," "forceful removal of detainees' clothing," "stress positions," "hooding," "manhandling," and "walling," which entails grabbing the detainee by his shirt and hoisting him against a specially constructed wall.

PEAPA Presses On

In early 2005, the APA appointed a Presidential Task Force to form ethics policy that was dominated by psychologists from the military and intelligence establishment, some of whom were involved in the very interrogation chains of command now shown to have facilitated abuse. The ethics policy of the APA and the report of the APA’s Presidential Task Force, taken together, currently allow psychologists to participate in national security interrogations, unlike physicians and psychiatrists, and even permits contravening the ethics code when faced with a conflicting “lawful order” from a governing authority....

The Vanity Fair article reports the role of psychologists in developing the CIA’s regime of abusive interrogations (”torture”). The article states “that psychologists weren’t merely complicit in America’s aggressive new interrogation regime. Psychologists, working in secrecy, had actually designed the tactics and trained interrogators in them while on contract to the CIA.” Psychologists James Mitchell and Bruce Jessen of the military’s Survival, Evasion, Resistance, Escape (SERE) program were brought in by the CIA to use SERE techniques, developed to help our soldiers resist collaboration if captured, to break down detainees.

While Mitchell and Jessen used so-called “enhanced” techniques such as waterboarding (i.e., simulated drowning), most of their techniques became staples of interrogation tactics toward detainees in the war on terror and the conflicts in Iraq and Afghanistan. The article quotes one source as describing the Mitchell and Jessen approach as being to “break down [the detainees] through isolation, [use] white noise, completely take away their ability to predict the future, [and] create dependence on interrogators.” The description of these techniques matches those techniques described by former interrogator Tony Lagouranis in his new book, Fear Up Harsh as being used by numerous interrogators in Iraq.

The PEAPA statement goes on to describe how the propagation of these abusive coercive techniquest -- of torture plain and simple -- was facilitated by the respectable cover of the scientific respectability of the psychological profession and of science in general.

I spoke out strongly against this latter role of modern "scientific" psychology over a year ago, in a diary at Daily Kos:

In [Alfred] McCoy's A Question of Torture, McCoy notes that a July 2005 survey of detainee medical care found the BSCT teams lacked clear guidelines, and "recommended the Army stop using psychiatrists and physicians to assist in interrogation". McCoy's narrative continues (p. 184):

Rejecting these recommendations... Lieutenant General Kevin C. Kiley, the Army's surgeon general, said they found, "no evidence of systemic problems in detainee medical care," praised the military's worldwide treatment for detainees, and deferred assessment of the BSCT teams to "more studies." In defense of his position that the role of these behavioral teams is "safe, legal and ethical," Kiley cited the APA task force report (PDF), noting that it reminded members to maintain "an ethical view of their duties. But it doesn't prohibit them from assisting in interrogations."

Thus do APA internal documents and resolutions make themselves into the very heart of Pentagon policy-making.

Action Against APA's Interrogation Position Becomes a Crucial Front Against Bush's War/Torture Policy

The PEAPA release continues:

In June, the Coalition for an Ethical APA sent an Open Letter to the President of the APA, Dr. Sharon Brehm, demanding swift and comprehensive changes in APA policy. In six weeks, the number of signatories to the letter has risen to over 650. The APA leadership has yet to respond to this letter. Soon afterwards, 58 psychologists from the National Consortium of Torture Treatment Programs issued an additional letter expressing outrage over the failure of the APA to adequately respond to the growing evidence of psychologist involvement in torture. Numerous individual psychologists have written additional letters of protest, and a group of APA members has organized a campaign to withhold their dues until the APA changes its ethical policy to prohibit such abuses.

While you should read the entire statement, PEAPA concludes with a strong call for action in cleaning up one of the United States's largest and most prestigious professional, scientific societies, one that has become over the years an adjunct to Pentagon misdeeds and imperialistic foreign policy:

The group urgently recommends the following:

1. The President of the APA must immediately acknowledge errors and abuses committed by its leadership, and substantively reaffirm its commitment to promoting adherence by all psychologists to international human rights standards.

2. The APA Board of Directors and Ethics Committee must endorse the APA Moratorium on psychologist participation in interrogations of foreign detainees, to be voted upon at the August convention.

3. The APA Board of Directors must encourage, support, and cooperate with ongoing Senate investigations into the role of psychologist’s utilization of SERE techniques in developing the US regime of psychological torture used at Guantanamo, in Iraq and Afghanistan, the CIA Black Sites, and elsewhere.

4. The APA Board of Directors must commence a neutral third-party investigation of its own involvement, and that of APA staff, in APA-military conflicts of interest. Among the issues this investigation must examine are:

a) the numerous procedural irregularities alleged to have occurred during the PENS process;

b) the role of the military and intelligence agencies in the formation and functioning of the PENS Task Force;

c) the reasons the APA and its leadership have systematically ignored the accumulating evidence that psychologists participating in interrogations are contributing to torture or cruel, inhuman, or degrading treatment, rather than helping to prevent it;

d) the overall nexus of close ties between the APA staff/leadership and the military and intelligence agencies, ties that may have contributed to a climate that permits undo influence of military and intelligence agencies in the creation of these policies and that encourages turning a blind eye to abuse;

e) the transformation of the APA Ethics Code, from one that protects psychologists’ ethical conduct when such conduct conflicts with law and military regulations to one that protects psychologists who follow unethical law and military regulations.

The Coalition for an Ethical APA calls on all concerned APA members and other psychologists to join them by signing the Open Letter to APA President Sharon Brehm at http://www.ipetitions.com/petition/BrehmLetter/, to participate actively in mini-convention sessions on ethics and interrogation at the APA Convention in San Francisco beginning this August 18th, and to join the demonstrations planned for this Convention [information available at http://ethicalapa.com/].

Conclusion

This has been a long article, but I cannot overemphasize the importance of the issues herein. As Congress reveals itself more and more to be a toothless lion when it comes to opposition to the Bush Administration's assault on civil liberties, and its everlasting war drive, assisted by torturers and military apologists and profiteers, the American people must stand up in their everyday institutions, at unions, at churches, in professional societies, if and where the opportunity arises.

Today, for better or worse, psychologists have a unique opportunity to both strike a blow against an illegal and immoral war and interrogation policy, and to save their own organization from calumny and ignominy as a handmaiden to barbaric treatment and callous indifference to the sufferings of the weak and the helpless.

Today, the center of the storm is moving incongruously over Nancy Pelosi's San Francisco, where next month a battle will be fought over the soul of an organization, and maybe, over the soul of a country. Will you be there?
